Quick answers about working with Miya Solicitors and starting a matter.

What types of legal cases does Miya Solicitors handle?

Miya Solicitors specialises in personal injury, clinical negligence, family law, immigration law, wills and probate and housing disrepair claims. Across these practice areas we represent private clients, families and small businesses in London and across the United Kingdom. If your matter does not fall into one of these areas, we are usually able to point you towards an appropriate specialist.

How do I start a matter with the firm?

You can begin by calling the office on 0203 750 4445, sending an email to [email protected] or completing the enquiry form on our contact page. We will arrange a short initial call so that we understand your situation, confirm there is no conflict of interest and explain the next steps and any documents we will need.

Do you offer a free initial consultation?

Yes. For most personal injury and clinical negligence enquiries, and for many other matters, we offer a no obligation initial discussion so that you understand your options before any costs arise. Your solicitor will explain whether your case is suitable, the likely process and how fees may be calculated.

Which languages can the team support?

The team can support clients in English, Turkish, Kurdish, Bulgarian, Somali and Arabic. Where a different language is needed we can usually arrange a professional interpreter.

Is Miya Solicitors regulated?

Yes. Miya Solicitors is authorised and regulated by the Solicitors Regulation Authority under SRA number 620580. We work to the SRA Standards and Regulations and the SRA Codes of Conduct for firms and solicitors.

5 questions

Personal injury and clinical negligence

Common questions about starting and running a claim.

How can I start a personal injury or clinical negligence claim?

You can start your claim by contacting us for a free initial consultation. Our solicitors will assess the merits of your case, explain your options in plain English and, where suitable, agree to act on a No Win No Fee basis so that you do not pay legal fees if your claim is unsuccessful.

How long do I have to make a claim?

The general time limit for most personal injury and clinical negligence claims is three years from the date of the incident, or from the date you became aware of your injury. Different rules apply for children, individuals lacking mental capacity and certain other situations, so please contact us as soon as possible to confirm the position in your case.

Can I claim compensation if I was partially at fault for my injury?

Yes, you may still be entitled to compensation even if you were partially at fault. This is known as contributory negligence. Any compensation awarded would normally be reduced by a percentage that reflects your share of the responsibility. Our solicitors will explain how this is likely to apply to your circumstances.

Do I have to attend court for my case?

Most personal injury and clinical negligence cases are settled out of court through negotiations with insurance companies or the responsible party. Where settlement cannot be reached, our litigators will issue court proceedings and represent you at any hearing. We prepare every case carefully so that your position is strong throughout.

How is compensation calculated in a personal injury claim?

Compensation reflects the severity of your injuries, pain and suffering, loss of earnings, medical expenses, rehabilitation costs and any future financial losses. Our solicitors gather medical and financial evidence to support a fair valuation of your claim.

3 questions

Immigration matters

Practical guidance on visa, settlement and appeal questions.

Which immigration matters can the firm assist with?

We advise on visit visas, settlement applications, indefinite leave to remain, family and partner visas, sponsor licences and business immigration, long residence applications, student visas, and administrative review and judicial review of refused decisions.

How long do immigration applications usually take?

Processing times depend on the route, evidence required and Home Office workload. Some applications are decided within a few weeks, others can take several months. Where speed is important, we will advise on whether priority or super priority services are available.

Do you provide fixed fees for immigration work?

Many immigration matters can be handled on a fixed fee basis. Before work starts we set out the scope of the service, what is included and any third party costs such as Home Office application fees, the Immigration Health Surcharge and translation or counsel's fees.

Family law

Answers for divorce, finances and arrangements for children.

Do you handle divorce, finances and child arrangements?

Yes. The team advises on divorce, separation, financial remedies, pre and post nuptial agreements, child arrangements orders and cross border family law issues. We work to keep matters as constructive as possible and use the court process where it is necessary.

Will you try to keep my matter out of court?

Wherever appropriate we look for a negotiated outcome through correspondence, mediation or round table meetings. Where court proceedings are necessary we explain the timetable and prepare your case carefully.

2 questions

Housing disrepair

What to expect from a housing disrepair claim.

What is a housing disrepair claim?

A housing disrepair claim is brought by a tenant against a landlord who has failed to repair the property within a reasonable time. Common issues include damp, mould, leaks, broken heating and structural defects. Compensation may be available for inconvenience, damage to belongings and any health impact.

Do I have to pay anything to bring a housing disrepair claim?

Where suitable we can act on a No Win No Fee basis for housing disrepair claims, so you do not pay legal fees if the claim is not successful. We will explain any deductions or third party costs at the outset.

2 questions

Wills and probate

Help with planning your estate and dealing with probate.

Can you draft a will for me?

Yes. Our wills service includes a careful discussion of your circumstances, drafting the will, arranging signing and witnessing in line with the legal formalities, and safe storage if requested. We can also advise on lasting powers of attorney and basic estate planning.

How does the probate process work?

After a death, an executor or administrator collects in the assets, pays liabilities and distributes the estate in line with the will or the intestacy rules. We can apply for the grant of probate, deal with HMRC where needed and handle the administration on your behalf.

3 questions

Fees, funding and complaints

How costs work and what to do if something goes wrong.

How are your fees calculated?

Fees may be charged on a fixed fee, hourly rate or No Win No Fee basis depending on the type of matter. Before any work starts we set out the basis of charging in writing and update you if circumstances change.

What is a No Win No Fee agreement?

A No Win No Fee agreement, also known as a Conditional Fee Agreement, means that if your claim is unsuccessful you do not pay our legal fees. Where suitable we can offer this funding option after assessing the merits of your case. A success fee may apply if the claim succeeds, and we will explain any deductions clearly at the outset.

How do I raise a complaint about your service?

If you are unhappy with our service please contact the firm so that we can review your concern. We will explain how your complaint will be handled, who will review it and the expected response timescale. Depending on the circumstances and timing you may also have rights to contact the Legal Ombudsman.
